Before registering for a Free Domino web site, all users must accept the Terms of Service Agreement (TOS) presented here and may change from time to time. Please refer to www.corefusion.com/tos for updates to the TOS.
By registering for this service you (the client) hereby agree to the following terms:
Authorization
The client is responsible for any and all licensing of materials however used. This includes but is not limited to: Lotus Domino Designer Client software application and applicable license, Graphic software and images, Trademarks, Patents and licensable materials.
The client acknowledges that they are legally allowed to enter into an agreement with coreFusion Inc. and is duly authorized to enter into agreements with coreFusion Inc.
Description of Service
coreFusion has agreed to provide services which allow the client to host a web site at no charge to the client. These services are not transfereable, nor are these services to be resold under any guise. Under no circumstances will the client be compensated in any manner for services, lack of services or the perception of the lack of services. As there is no fee charged for these services, there is no facility to be reimbursed or compensated for any reason. Note: For fee based services, refer to the Refunds section later in this document for more information.
All clients are responsible for any and all tools necessary to create a web site under the terms of this agreement. The client is also responsible for obtaining connectivity to the Internet to facilitate the building and management of the web site.
Client Obligations
By registering for this free service, the client agrees to provide full, accurate and truthful information as requested at the time of registration and from time to time as requested by coreFusion, coreFusion staff and agents.
Failure to provide accurate and truthful information is cause for termination of service. Failure to comply with the laws and regulations of the territory in which you reside and that of any territories in which coreFusion has responsibility is also cause for termination.
Any abuse of the system will be considered cause for immediate termination. This includes but is not limited to:
Spam
Hacking (unauthorized use)
Inflamatory content
Hate literature, including, sexist, ageist or racist content
Pornography
Browsing of other free users databases on the server, other than from a web browser
Attempting to browse other free users databases on the server, other than from a web browser
Attempting to browse any database not associated with your free service, i.e. names.nsf, log.nsf, etc on any coreFusion server, whether from a web browser or Lotus Notes client or other software.
Sending or attempting to send e-mail messages of any kind to anyone.
The client is fully responsible for any and all software licensing however incurred.
Services provided are for the use of the specific database as registered, all other accesses or attempted access of any other database, document, or other entity will be cause for immediate termination of service. Port scans, "browsing" or other attempts at accessing data or information however initiated, will be cause for immediate termination of service with no notice and possible legal action.
coreFusion Obligations
Any materials published by the client remain the property of the client after consideration of the above terms. coreFusion makes no claim to any content and will not duplicate, sell or otherise unlawfully use or distribute any client materials, documents or data.
No client information will be sold or given in any way to any third party. All client information gathered is used exclusively for the purposes of determining identity and communicating information with respect to the services offered.
No support is offered nor implied. For assistance with any aspect of this free service, refer to the TOS (this document) and the FAQ. Send all enquiries to: free.hosting@corefusion.com A discussion database is also available for the purpose of communicating amongst the client base and offering suggestions/help to each other. Although coreFusion staff monitor and offer advice in this database, it is not an official support mechanism.
Fee based services
All services whether offered for free or for a fee are subject to the terms of this document. All services can be terminated instantly at our sole discretion for abuse of the system, or failure to comply with the terms of this document.
All Personal Agents will be inspected prior to being enabled on the system. A random test will be performed at coreFusion's discretion to determine if any Agent is causing problems/failures or interference with any other web site or the system in general. Any Agent found to be causing any system failure or problem will result in the clients access to the FREE hosting service to be suspended. The client will be contacted and given 72 hours to repair or remove the agent. After 72 hours, if the Agent is still not operable, the client's account can be terminated immediately. Agents that cause the clients web site to breach the terms of this document are also subject to the same termination process.
Refunds
All upgraded, fee based services are billed in advance for one year. In the event that you wish to discontinue your services, simply inform us of your intention via e-mail to: billing@corefusion.com, stating your intention to discontinue and a phone number where you can be reached for verification. Once we confirm your intention to discontinue the services, we will refund the remainder of your account starting on the next full month. You will still have access to the account for this time. You must inform us before the 15th of the month to get a refund for the following month, otherwise, your account will be active for an additional month.
For example, if you tell us on January 12, that you wish to discontinue your service and you have paid until the end of August, we will refund your fees from February - August, and you will still be able to access your account until the end of January. However, if you inform us on January 21, we will refund your fees from March - August and you will still be able to access your account until the end of February.
Any accounts terminated for breach of the Terms of Service will be subject to a fee of 50% of the remaining funds in the account at the time of termination. coreFusion is not responsible for loss of data or business, however caused.
coreFusion reserves the right to cancel or extend this offer at will, with no advance notification whatsoever.
coreFusion will attempt to provide as much notice to changes of this service as is practical.
